3. NATURE OF PLATFORM & SCOPE OF SERVICES

ASETRAX LIMITED operates an online Australia and New Zealand (ANZ) property listing, marketplace, and digital advertising directory. The Platform serves as an intermediary platform connecting prospective buyers, tenants, and real estate service consumers with independent real estate agents, agencies, property developers, commercial listings, and third-party service providers. Services provided directly by ASETRAX LIMITED are limited to listing displays, user account hosting, communications hosting, membership plans, and platform advertising features.
3.2 Exclusion of Regulated Capacities
Unless expressly stated otherwise in a separate, fully executed written agreement, ASETRAX LIMITED is not:
- A licensed real estate agency, agent, salesperson, or property manager under the Real Estate Agents Act 2008 (NZ) or equivalent State/Territory legislation in Australia;
- A conveyancer, legal practitioner, certified surveyor, or registered valuer; or
- A provider of financial advice, mortgage broking, tax advisory, or financial product investment advice under the Financial Markets Conduct Act 2013 (NZ), the Corporations Act 2001 (Cth), or related regulatory frameworks.
3.3 Excluded Transactions
ASETRAX LIMITED does not negotiate, execute, or complete real estate sales or lease agreements; does not receive, hold, or disburse client monies or trust funds; and does not provide individual financial, legal, tax, or investment advice.
4. THIRD-PARTY CONTENT & INDEPENDENT VERIFICATION
4.1 Contributor Responsibility
Property listings, projects, agent or developer profiles, imagery, audio-visual materials, pricing, rental return estimates, and investment yield claims are supplied entirely by third parties and platform users. The relevant publisher or contributor remains strictly and solely responsible for ensuring that all submitted information is accurate, current, lawful, and complete.
4.2 Statutory Disclaimer & Verification Duty
ASETRAX LIMITED makes no express or implied representation or warranty regarding the accuracy, legal compliance, or suitability of third-party listings. Users are strictly advised to independently verify:
- Property boundary lines, titles, and legal ownership;
- Statutory approvals, building consents, and zoning laws;
- Foreign investment regulatory compliance (e.g., Overseas Investment Office (OIO) requirements in New Zealand or Foreign Investment Review Board (FIRB) approvals in Australia); and
- Financial projections, yield calculations, and taxation implications.
Users must obtain independent legal, financial, and technical advice prior to signing contract documentation or transferring deposit funds.
5. ACCOUNT REGISTRATION & CONDUCT
Users, agents, agencies, and developers registering account profiles on the Platform must comply with the AsetraX Terms and Conditions and Acceptable Use Policy. Account holders bear total responsibility for all activity, content submissions, and representations originating from their credentials.
6. INTELLECTUAL PROPERTY RIGHTS
All proprietary software code, web architecture, design elements, logos, registered and unregistered trademarks (including ASETRAX™ and Assets Property Hub™), and original content created by ASETRAX LIMITED remain the exclusive property of ASETRAX LIMITED or its licensors. Nothing contained on the Platform conveys or transfers any intellectual property license or ownership rights to any user. Third-party trademarks and listing media remain the property of their respective owners.
7. HYPERLINKS & AFFILIATE DISCLOSURES
External Websites: The Platform contains hyperlinked referral connections to external third-party entities. ASETRAX LIMITED exercises no operational control over third-party platforms and assumes no legal liability for external content, practices, or transactions.
Commercial Relationships: ASETRAX LIMITED participates in commercial arrangements and affiliate programs. The Platform may receive referral fees, advertising revenue, or commissions upon qualifying lead generations or customer actions, as further detailed in the AsetraX Affiliate Disclosure.
8. STATUTORY CONSUMER RIGHTS
Nothing in this Imprint purports to exclude, restrict, or modify any statutory consumer guarantees, non-excludable remedies, or rights guaranteed under:
