AsetraX does not verify, check, audit, or confirm:

2.3 Property Condition and Legal Status
Users should not rely on Platform listings for information about:
- Structural integrity or building defects
- Compliance with building codes or health and safety regulations
- Environmental hazards or contamination
- Flooding, earthquake, or natural disaster risk
- Boundary disputes or legal encumbrances
- Outstanding rates, taxes, or utility arrears
- Consent requirements (Foreign Buyer, Resource Consent, etc.)
Obtain independent professional reports including:
- Building inspections and engineering reports
- Legal searches and property conveyancing reports
- Geotechnical or environmental assessments

4. Foreign Buyer and Overseas Investment Compliance
4.1 No OIA Advice
AsetraX does not provide advice on the Overseas Investment Act 2005 (NZ), FIRB (Foreign Investment Review Board) requirements in Australia, or any other foreign investment legislation.
4.2 Foreign Buyer Eligibility Not Verified
Where a listing is designated as “Foreign Buyer Eligible,” AsetraX has not verified this designation. Users who are overseas persons must:
- Independently determine their eligibility to acquire the property
- Verify compliance with all applicable foreign investment laws
- Obtain independent legal advice from a specialist immigration or property lawyer
- Obtain all required consents (OIA, FIRB, state restrictions, etc.)

AsetraX does not verify whether any Lister holds:

5.2 Lister Profile Labels Are Self-Reported
The labels “Agent,” “Agency,” or “Developer” displayed on Lister profiles are self-reported and not independently verified. Users should independently verify licensing and credentials before engaging any Lister.

In Australia: Check relevant state or territory real estate licensing websites
5.3 AsetraX Is Not a Real Estate Agency
AsetraX does not hold a real estate licence and does not conduct “real estate agency work” under the REAA 2008 or equivalent legislation. We do not:
- Negotiate transactions on your behalf
- Hold client funds or trust accounts
- Provide real estate or property advice
- Act as an intermediary or agent
6. Platform Availability and Technical Issues

- Any dispute or disagreement
- Any breach or default
10.2 Communications Are Not Confidential
Communications made through the Platform enquiry system or on-Platform messaging:
- Are not encrypted
- May be accessed by AsetraX staff for moderation or compliance
- May be retained in our systems indefinitely
- Are not protected as confidential
For sensitive discussions, use private email, phone, or meet in person.
10.3 No Mediation or Arbitration
AsetraX does not mediate disputes between Users and Listers. If a dispute arises:
- Attempt to resolve directly between the parties
- Seek legal advice if necessary
- Contact relevant regulatory bodies (REA, ACCC, etc.)
- Pursue civil litigation if needed
11. Legal and Compliance Matters
11.1 Regulatory Compliance Not Verified
AsetraX does not verify whether Listers comply with:
- Real estate licensing laws (REAA 2008, state/territory legislation)
- Property advertising standards
- Consumer protection laws
- Fair trading laws
- Anti-discrimination laws
- Overseas investment regulations
11.2 Your Responsibility
Users are responsible for:
- Verifying that Listers comply with applicable laws
- Reporting regulatory violations to relevant authorities (REA, ASIC, ACCC, etc.)
- Ensuring their own conduct complies with applicable laws
- Understanding applicable laws in their jurisdiction
