1. Purpose

This Acceptable Use Policy (“AUP”) sets out the rules governing how all users may access and use the AsetraX Platform at https://assetspropertyhub.com (“Platform”). It applies to every person who visits, registers on, or interacts with the Platform, including Users, Agents, Agencies, Developers, Affiliate Partners, and any other person accessing the Platform in any capacity (collectively, “you”).

This AUP forms part of our Terms and Conditions and should be read alongside our Privacy Statement and Disclaimer. By using the Platform, you agree to comply with this AUP. If you do not agree, you must not use the Platform.

2. General Principles

You must use the Platform:

  • honestly, in good faith, and for its intended purpose as a property marketplace
  • in compliance with all applicable laws and regulations in New Zealand, Australia, and any other jurisdiction from which you access the Platform
  • in a manner that respects the rights, safety, and privacy of other users and third parties
  • without attempting to gain an unfair advantage over other users or to undermine the integrity of the Platform

3. Prohibited Conduct, All Users

The following conduct is strictly prohibited for all users of the Platform regardless of account type:

3.1 Illegal Activity

  • Using the Platform for any purpose that is unlawful under New Zealand law, Australian law, or any other applicable law
  • Publishing, distributing, or transmitting content that is defamatory, fraudulent, misleading, deceptive, or in breach of the Fair Trading Act 1986 (NZ) or the Australian Consumer Law
  • Using the Platform to facilitate money laundering, fraud, identity theft, or any activity that breaches the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (NZ) or equivalent Australian legislation
  • Impersonating any person, business, or organisation, or misrepresenting your identity, qualifications, or professional status

3.2 Harmful Content

  • Uploading, posting, or transmitting any content that is offensive, abusive, threatening, harassing, hateful, discriminatory, or obscene
  • Publishing content that violates the Human Rights Act 1993 (NZ), the Racial Discrimination Act 1975 (Cth), or equivalent legislation
  • Uploading malware, viruses, ransomware, spyware, or any other malicious code
  • Engaging in any conduct that could damage, disrupt, or impair the Platform or its infrastructure

3.3 Privacy Violations

  • Collecting, harvesting, or storing personal information about other users without their knowledge or consent
  • Using any personal information obtained through the Platform for any purpose other than its intended use (e.g. using a User’s contact details obtained via an enquiry to send unsolicited marketing communications)
  • Violating the Privacy Act 2020 (NZ) or the Privacy Act 1988 (Cth) in connection with any activity carried out on or through the Platform

3.4 Intellectual Property

  • Reproducing, copying, distributing, or commercially exploiting any content from the Platform without prior written permission from AsetraX or the relevant rights holder
  • Uploading content that infringes the intellectual property rights of any third party, including copyright, trade marks, or design rights
  • Scraping, data mining, or extracting listing data or user data from the Platform by automated or manual means without prior written consent from AsetraX

3.5 Platform Integrity

  • Attempting to gain unauthorised access to any account, system, or database connected to the Platform
  • Using bots, crawlers, scripts, or automated tools to interact with the Platform without prior written consent from AsetraX
  • Circumventing, disabling, or interfering with any security, access control, or content restriction mechanism on the Platform
  • Attempting to reverse engineer, decompile, or extract the source code of any part of the Platform
  • Creating multiple accounts to circumvent a suspension, ban, or any limitation applied to a previous account

4. Additional Rules for Listers (Agents, Agencies, and Developers)

In addition to the general rules in Section 3, the following additional requirements apply to all registered Listers who publish property listings on the Platform.

4.1 Licensing and Professional Compliance

  • You must hold all licences, registrations, and authorisations required to conduct real estate activity in the jurisdiction(s) in which you operate, including a current licence under the Real Estate Agents Act 2008 (NZ) or equivalent Australian state or territory legislation
  • You must not publish listings on behalf of a property owner without holding a valid agency agreement or authority to do so
  • You must not make representations about a property that you know, or ought reasonably to know, are false, misleading, or deceptive

4.2 Listing Content Standards

  • All listing content must be accurate, current, and a fair representation of the property at the time of publication
  • Pricing must be stated in a clear and transparent manner and comply with real estate advertising standards applicable in the relevant jurisdiction
  • You must not publish duplicate listings for the same property across multiple listing entries
  • Listing images must accurately represent the property and must not be digitally altered in a manner that misrepresents the property’s condition, size, or features
  • You must not use listing descriptions to solicit off-platform transactions, provide personal contact details in listing body text for the purpose of bypassing the Platform’s enquiry system, or direct Users to competing platforms
  • Where a listing is marked “Foreign Buyer Eligible,” you are solely responsible for the accuracy of that designation and must have a reasonable basis for making it under the Overseas Investment Act 2005 (NZ) or applicable Australian foreign investment legislation

4.3 Enquiry Handling

  • Personal information received via User enquiries through the Platform must be used solely for the purpose of responding to that enquiry
  • You must not add enquiring Users to marketing lists, CRM databases, or third-party mailing lists without their explicit consent
  • You must respond to enquiries in a timely and professional manner

4.4 Membership Integrity

  • You must not share your account credentials with any other person
  • Each individual agent must hold their own individual Membership, account sharing between multiple agents is not permitted under an individual Agent Membership

5. Additional Rules for Affiliate Partners

In addition to the general rules in Section 3, the following requirements apply to all Affiliate Partners participating in the AsetraX Referral Program.

  • You must not make false, misleading, or exaggerated claims about AsetraX, its Platform, or its services in the course of promoting your referral link
  • You must not engage in spam, unsolicited email marketing, or any form of mass messaging to promote your referral link
  • You must not use paid advertising that uses AsetraX brand terms, trade marks, or domain names without prior written consent
  • You must not self-refer or create fictitious accounts for the purpose of generating referral commissions
  • You must comply with all applicable advertising disclosure requirements, including the requirement to disclose affiliate relationships where required by the Fair Trading Act 1986 (NZ) or the Australian Consumer Law

Breach of these affiliate-specific rules may result in forfeiture of pending commissions in addition to suspension or termination of your Affiliate Partner account.

6. User-Generated Content

Where you upload, post, or submit any content to the Platform, including listing descriptions, images, profile information, blog comments, or enquiry messages, you represent and warrant that:

  • you own or have the necessary rights, licences, and permissions to submit that content
  • the content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
  • the content is accurate and not misleading
  • the content complies with this AUP and all applicable laws

By submitting content to the Platform, you grant AsetraX a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content for the purposes of operating and promoting the Platform. You retain ownership of your content. AsetraX does not claim ownership of user-submitted content.

AsetraX reserves the right to remove any user-generated content that breaches this AUP without notice and without liability.

7. Reporting Violations

If you encounter content or conduct on the Platform that you believe violates this AUP, please report it to us at:

Please include the URL of the relevant content or listing and a brief description of the concern. We will review all reports in good faith and take action where appropriate. We cannot guarantee a response to every report but will investigate all credible complaints.

8. Enforcement

AsetraX reserves the right to take any of the following actions in response to a breach or suspected breach of this AUP, at our sole discretion and without prior notice:

  • issue a formal warning to your account
  • temporarily suspend your account and Membership
  • permanently terminate your account and Membership
  • remove any content that breaches this AUP
  • forfeit any pending affiliate commissions where the breach relates to affiliate activity
  • report your conduct to relevant regulatory authorities, law enforcement agencies, or professional licensing bodies (e.g. the Real Estate Authority (NZ) or equivalent Australian regulator)
  • pursue civil remedies including injunctive relief or damages where permitted by law

Where a Membership is terminated for breach of this AUP, no refund will be issued. Please refer to our Refund Policy for full details.

9. Consequences of Termination

Upon termination of your account for breach of this AUP:

  • your access to the Platform will cease immediately
  • all active listings associated with your account will be removed from public view
  • any pending affiliate commissions may be forfeited
  • you remain liable for any obligations that arose prior to termination, including outstanding fees

AsetraX reserves the right to refuse re-registration to any person or entity whose account has been terminated for breach of this AUP.

10. Disclaimer of Liability

AsetraX is not responsible for user-generated content published on the Platform and does not endorse any content submitted by users. We do not pre-screen all content before publication. If you believe a listing or any content on the Platform is false, misleading, or in breach of this AUP, please report it using the process in Section 7.

To the extent permitted by applicable law, AsetraX excludes all liability for loss or damage arising from your reliance on user-generated content published on the Platform.

11. Amendments

AsetraX reserves the right to update this AUP at any time. The date at the top of this document reflects the most recent revision. We will notify registered users of material changes by email and by posting a notice on the Platform. Your continued use of the Platform after the effective date of any update constitutes acceptance of the revised AUP.

12. Governing Law

This AUP is governed by the laws of New Zealand. Any dispute arising in connection with this AUP will be subject to the dispute resolution process set out in our Terms and Conditions, mediation first, followed by the courts of New Zealand.
