While we endeavour to keep information accurate and up to date, AsetraX (Assets Property Hub), operated by Kim Troy Gida Babion trading as AsetraX (“we”, “us”, “our”), makes no representations, warranties, or guarantees of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of any information, listing, content, product, or service displayed on the Platform.
Your use of any information on the Platform is entirely at your own risk. AsetraX accepts no liability for any loss or damage, including without limitation indirect or consequential loss or damage, arising from reliance on any content displayed on the Platform.

Nothing on this Platform constitutes financial advice, investment advice, legal advice, taxation advice, or any other form of professional advice.
AsetraX is a property marketplace platform. We provide technology infrastructure that enables property listings to be published and discovered. AsetraX is not a licensed real estate agency or real estate agent in any jurisdiction, including:
- New Zealand, where AsetraX does not hold a licence under the Real Estate Agents Act 2008 (NZ) and does not carry out “real estate agency work” as defined under that Act;
- New South Wales (Australia), where AsetraX does not hold a licence under the Property and Stock Agents Act 2002 (NSW);
- Victoria (Australia), where AsetraX does not hold a licence under the Estate Agents Act 1980 (VIC);
- Queensland (Australia), where AsetraX does not hold a licence under the Property Occupations Act 2014 (QLD);
- Western Australia (Australia), where AsetraX does not hold a licence under the Real Estate and Business Agents Act 1978 (WA);
- Any other Australian state or territory in which real estate agent licensing is required by law.
AsetraX is not a licensed financial adviser, mortgage broker, legal practitioner, or investment adviser in New Zealand or Australia.
Any property-related information, market commentary, pricing data, yield estimates, return on investment indicators, or investment-focused descriptions displayed on the Platform are provided for general informational purposes only and must not be relied upon as the basis for any financial, investment, or purchasing decision.
Before entering into any property transaction or making any investment decision, you should seek independent advice from a qualified and licensed professional including, as appropriate:
- a registered real estate agent licensed under the Real Estate Agents Act 2008 (NZ) or equivalent Australian state or territory legislation
- a licensed financial adviser under the Financial Markets Conduct Act 2013 (NZ) or equivalent Australian legislation
- a qualified solicitor or conveyancer

3. Property Listing Disclaimer
All property listings published on the Platform are submitted by independent third-party Listers (Agents, Agencies, and Developers). AsetraX does not verify, audit, or independently confirm the accuracy of any listing content, including but not limited to:
- property descriptions, pricing, or availability
- floor plans, measurements, or imagery
- rental yield estimates or investment return projections
- property legal status, ownership, or title
- zoning classifications or development potential
- foreign buyer eligibility designations
Foreign Buyer Eligibility: Where a listing is marked as “Foreign Buyer Eligible,” this designation is provided solely by the Lister and has not been independently verified by AsetraX. Prospective buyers who are not New Zealand citizens or permanent residents must obtain independent legal advice regarding their eligibility to purchase property under the Overseas Investment Act 2005 (NZ) or applicable Australian foreign investment legislation before entering into any transaction. AsetraX accepts no liability for any regulatory breach, financial loss, or legal consequence arising from reliance on this designation.
Prospective buyers, tenants, and investors are strongly encouraged to conduct their own due diligence, engage qualified professionals, and verify all material facts independently before making any decision in connection with a property listed on the Platform.
4. No Agency Relationship
AsetraX is not a party to any transaction between a Lister and a User. We do not act as agent, broker, representative, or adviser for either party in connection with any transaction facilitated through or in connection with the Platform.
Submitting an enquiry through the Platform does not create any obligation on the part of AsetraX or any Lister to respond, negotiate, or proceed with any transaction.
No agency, partnership, joint venture, employment, or fiduciary relationship is created between AsetraX and any Lister or User by reason of these terms or use of the Platform.
5. Lister Credentials
AsetraX does not verify the licensing, registration, professional credentials, or legal standing of any Agent, Agency, or Developer registered on the Platform. Users are responsible for independently verifying that any Lister they engage is duly licensed and authorised under the Real Estate Agents Act 2008 (NZ) or equivalent Australian state or territory legislation before entering into any agreement with them.
In New Zealand, licence status can be verified via the Real Estate Authority (REA) public register at https://www.rea.govt.nz.
In Australia, licensing registers are maintained by each state and territory’s fair trading or consumer affairs authority.
6. Market and Pricing Information
Any market commentary, suburb data, price guides, median values, rental yield estimates, or growth indicators referenced on the Platform or in blog content are provided for general informational purposes only. Property markets are subject to change. Past performance is not indicative of future results. AsetraX does not warrant the accuracy of any market or pricing data and accepts no responsibility for decisions made in reliance on such information.
7. Blog and Editorial Content
The AsetraX blog and any editorial or informational articles published on the Platform represent general commentary only. They do not constitute professional advice of any kind. Views expressed in blog posts are informational in nature and should not be relied upon as a substitute for professional legal, financial, investment, or real estate advice.
8. Affiliate Disclosure
AsetraX operates an affiliate referral program through which Affiliate Partners may earn commissions for referring new paying members to the Platform. AsetraX may also participate in third-party affiliate or referral arrangements through which we receive a fee or commission on the promotion of third-party products or services.
Where affiliate or referral relationships exist, they are disclosed in accordance with the Fair Trading Act 1986 (NZ) and applicable Australian consumer law requirements. 10. Platform Availability
AsetraX does not guarantee that the Platform will be available at all times or free from interruption, error, or technical faults. We reserve the right to suspend, modify, or discontinue any part of the Platform at any time without notice. We accept no liability for any loss or inconvenience arising from Platform downtime, technical errors, or changes to Platform features.
11. Jurisdictional Limitations
The Platform is primarily intended for users in New Zealand and Australia. AsetraX makes no representation that the Platform or its content is appropriate, available, or compliant with the laws of any jurisdiction outside New Zealand and Australia. Users who access the Platform from other jurisdictions do so at their own risk and are responsible for compliance with all applicable local laws.
